Start a defense company in Ukraine

Plan a responsible Ukrainian defense venture around classification, permits, procurement, security and production evidence.

Defense technology has the obligations of an ordinary business plus product classification, controlled information, procurement, production safety and possible export-control or licensing requirements. These are design inputs, not paperwork to add after a prototype succeeds.

This is a high-level company-setup guide. It does not provide weapons construction or operational instructions. Obtain specialist advice for the exact product, customers and supply chain.

Classify the product and activity first

Describe what the company develops, manufactures, imports, exports, repairs or supplies. Determine whether products, components, software or technical data fall under military, dual-use, cryptographic, aviation or other controlled categories.

Classification affects licensing, registration, premises, personnel, customer due diligence, transfers and recordkeeping. Do not rely on marketing labels such as “civilian” or “AI” in place of a formal analysis.

Create the authorization matrix

List every possible license, permit, declaration, exporter/importer authorization, conformity process and customer approval. For each, record the product/activity scope, responsible authority, prerequisites, lead time, renewal and records.

No single “defense license” answers every case. Manufacturing, trade, international transfer and handling particular materials may be governed separately.

Protect information and technology

Classify internal information, restrict access by role, use managed devices and multifactor authentication, separate sensitive repositories, log transfers and revoke access immediately on exit. Contracts should cover confidentiality, IP, publication, open-source use and controlled technical data.

If state secrets or formally restricted information may be involved, stop informal sharing and establish the required secure process with qualified counsel and authorities.

Plan production and quality evidence

Build traceability for suppliers, components, configuration, testing, acceptance, nonconformity and field feedback. Safety-critical claims must be supported by controlled tests. Use the manufacturing guide for site, customs and workforce planning.

Sell and export responsibly

Map public procurement and direct-contract routes, qualification evidence, pricing, delivery, acceptance, warranty and anti-corruption controls. Screen end users and end use. Never ship, demo abroad, email controlled technical data or allow foreign access before checking export-control requirements.

  1. Classify product, software, components and technical data.
  2. Confirm company, ownership and foreign-access constraints.
  3. Build the authorization and renewal matrix.
  4. Establish security, sanctions and counterparty controls.
  5. Assign IP and restrict sensitive repository access.
  6. Implement quality, traceability and incident evidence.
  7. Validate procurement and export paths before promising delivery.
  8. Reassess classification after every material product change.
